10-1-4: CONSTRUCTION SITES FREE OF DEBRIS:
   A.   Definitions: The following terms shall have the following meanings:
      CITY: The city of Albertville.
      CONSTRUCTION DEBRIS CONTAINER: A rigid, freestanding enclosure consisting of a solid metal bottom and solid metal sides constructed in such a manner that no gaps, holes or other spaces exist between the sides or between the bottom and sides, and which has a cover made of netting or a solid, rigid material which covers the entire top of the enclosure and does not allow materials from inside the enclosure to exit the enclosure when the cover is closed.
      CONSTRUCTION MATERIALS: All materials of any type which are used in the construction of a house, building, or other structure, including, but not limited to, lumber, plastics, metal, asphalt and fiberglass shingles, fiberglass, vinyl, glass, ceramic, and other composite building materials.
      CONSTRUCTION SITE: A property in the city on which a structure is being constructed upon which a temporary or final occupancy permit has not yet been issued.
      DEBRIS: All excess construction materials, construction material shipping cartons, construction material packaging, and used construction materials which are present at a construction site and which are not secured in a "construction debris container" as defined in this subsection.
   B.   Sites Free Of Debris: All construction sites shall be free of debris at all times.
   C.   Construction Debris Containers:
      1.   Use Required: All construction sites shall have a construction debris container located on site, and all construction debris shall be contained within such container at all times.
      2.   Containers To Be Covered: All construction debris containers shall be securely covered at all times (the cover may be removed only for such time as is necessary to deposit or remove construction debris from the container) such that no debris is able to leave the enclosure by force of wind, gravity or other event.
   D.   Refusal Of Inspection; Stop Work Order:
      1.   The city building official may refuse to inspect any property and may issue a stop work order on any property which:
         a.   Contains debris that is not in a fully enclosed construction debris container;
         b.   Does not have a construction debris container located on site; or
         c.   Has a construction debris container which does not meet the requirements of this section or which is not securely covered.
      2.   Upon compliance with this section, any stop work order so issued may be rescinded, and inspections may resume. (Ord. 2003-16, 8-18-2003)
   E.   Misdemeanor Violation; Penalty: Any person or entity in violation of this section shall be guilty of a misdemeanor, punishable by a fine as provided in section 1-4-1 of this code, plus the city's costs of prosecution. (Ord. 2003-16, 8-18-2003; amd. 2005 Code)
