§ 93.11 PLANTINGS UPON RIGHT-OF-WAY.
   (A)   Unless otherwise allowed by permit as stated in division (C) below, it shall be violation of this section to insert, plant or maintain the following in any public rights-of-way in the Town of Albany:
      (1)   Any tree, shrub or bush over 12 inches in height;
      (2)   Any other plant life over 12 inches tall; and
      (3)   Any improvement, including without limitation, any improvement designed to assist the growth of any plant life.
   (B)   Division (A) above shall not be construed to prohibit the insertion, planting or maintenance of grass or plant life less then 12 inches tall in the town’s rights-of-way.
   (C)   In the event a citizen of the Town of Albany desires to plant a tree, shrub, or bush in the town’s rights-of-way, the citizen must:
      (1)   Pay a permit fee of $10 on a form provided by the town; and
      (2)   Attend a Town Board meeting to gain approval before planting the tree, shrub or bush.
