§ 51.41 DETERMINATION OF SEWER RATES AND CHARGES.
   For the use of and the service rendered by sewage works, rates and charges shall be collected from the owners of each and every lot, parcel of real estate or building that is connected with the town sanitary system or otherwise discharges sanitary sewage, industrial wastes, water or other liquids, either directly or indirectly, into the sanitary sewerage system of the town. Such rate and charges include user charges, debt service costs, excessive strength surcharges and other service charges, which rates and charges shall be payable as hereinafter provided and shall be in an amount determinable as follows:
   (A)   (1)   The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the same is measured by the water meter there in use, plus a base charge, except as herein otherwise provided. For the purpose of billing and collecting the charges for sewage service, the water meters shall be read monthly (or period equaling a month). The water usage schedule on which the amount of said rates and charges shall be determined is as follows for the period of September 1, 2015 through August 31, 2016:
         (a)   Residential users.
            1.   Base rate: $30.68 per month; and
            2.   Flow charge: $5.15 per 1,000 gallons used per month.
         (b)    Commercial/governmental/institutional/industrial users.
            1.   Base rate per month as follows:
               a.   3/4 or 5/8-inch meter: $30.68
               b.    One-inch meter: $83.50
               c.   1 1/2-inch meter: $179.54
               d.    Two-inch meter: $278.21
               e.    Three- and four-inch meter:                 $524.58
            2.   Flow charge: $5.15 per 1,000 gallons used per month.
         (c)   Industrial users who pretreat and who use more than 30,000 gallons per month.
            1.   Base rate per month as follows:
               a.   3/4 or 5/8-inch meter: $30.68
               b.    One-inch meter: $83.50
               c.   1 1/2-inch meter: $179.54
               d.    Two-inch meter: $278.21
               e.    Three- and four-inch meter:                 $524.58
            2.   Flow charge: $.83 per 1,000 gallons used per month.
      (2)   The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the water meter there measures the same in use, plus a base charge, except as herein otherwise provided. For the purpose of billing and collecting the charges for sewage service, the water meters shall be read monthly (or period equaling a month). The water usage schedule on which the amount of said rates and charges shall be determined is as follows for the period of September 1, 2016 through August 31, 2017:
         (a)   Residential users.
            1.   Base rate: 35.68 per month; and
            2.   Flow charge: $5.15 per 1,000 gallons used per month.
         (b)    Commercial/governmental/institu- tional/industrial users.
            1.   Base rate per month as follows:
               a.   3/4 or 5/8-inch meter: $35.68
               b.    One-inch meter: $88.50
               c.   1 1/2-inch meter: $184.54
               d.    Two-inch meter: $283.21
               e.    Three- and four-inch meters: $529.58   
            2.   Flow charge: $5.15 per 1,000 gallons used per month.
         (c)   Industrial users who pretreat and who use more than 30,000 gallons per month.
            1.   Base rate per month as follows:
               a.   3/4 or 5/8-inch meter: $35.68
               b.    One-inch meter: $88.50
               c.   1 1/2-inch meter: $184.54
               d.    Two-inch meter: $283.21
               e.    Three- and four-inch meters: $529.58   
            2.   Flow charge: $.83 per 1,000 gallons used per month.
      (3)   The sewage rates and charges shall be based on the quantity of water used on or in the property or premises subject to such rates and charges, as the water meter there measures the same in use, plus a base charge, except as herein otherwise provided. For the purpose of billing and collecting the charges for sewage service, the water meters shall be read monthly (or period equaling a month). The water usage schedule on which the amount of said rates and charges shall be determined is as follows for the period beginning September 1, 2017:
         (a)   Residential users.
            1.   Base rate of $35.68 per month; and
            2.   Flow charge of $7.75 per 1,000 gallons used per month.
         (b)    Commercial/governmental/institutional/industrial users.
            1.   Base rate per month as follows:
               a.   3/4 or 5/8-inch meter: $35.68
               b.    One-inch meter: $88.50;
               c.   1 1/2-inch-meter: $184.54
               d.    Two-inch meter: $283.21
               e.    Three- and four-inch meters: $529.58
            2.   Flow charge: $7.75 per 1,000 gallons used per month.
         (c)   Industrial users who pretreat and who use more than 30,000 gallons per month.
            1.   Base rate per month as follows:
               a.   3/4 or 5/8-inch meter: $35.68
               b.    One- inch meter: $88.50
               c.   1 1/2-inch meter: $184.54
               d.    Two-inch meter: $283.21
               e.    Three- and four-inch meters: $529.58
            2.   Flow charge: $1.16 per 1,000 gallons used per month.
   (B)   For residential users of the sewage works that are unmetered water users or accurate meter readings are not available, residential users shall be assessed a flat fee. Sewage service bills shall be rendered once each month (or period equaling a month). The schedule on which said rate and charges shall be determined is as follows:
      Flat fee: $54.01 per month
   (C)   For service rendered to the Town of Albany, said town shall be subject to the same rates and charges provided in this subchapter.
   (D)   In order to recover the cost of monitoring industrial wastes, the town shall charge the user the actual cost of monitoring but not less than $25 per sampling event. This charge will be reviewed on the same basis as all other rates and charges in this subchapter.
   (E)   Insufficient checks are addressed in § 51.09.
   (F)   In the event that a property owner has multiple connections to the town's sanitary sewer utility from one parcel or multiple parcels, they shall pay the minimum debt service fee for each connection. The additional monthly charges shall be billed on the main water connection bill.
   (G)   Where a metered water supply is used for fire protection, the town may, at its discretion, make adjustments in the user charges as may be equitable.
   (H)   Lawn sprinkling.
      (1)   Where a metered water supply is used for lawn sprinkling, the town residential users (single and multi-family) who have water usage higher than the average usage for the billing months of July, August and September (usage dates of May 15 through August 15) shall have their sewage charges based on the accumulated average water usage from the previous billing months of November, December and January (usage dates of September 15 through December 15). In the event the water usage for the accumulated months is greater than the actual water usage for the summer months, the billing for sewage services shall be computed on the actual water used.
      (2)   The sprinkling rate shall not apply to any premises which are partially or wholly used for commercial or industrial purposes. In the event a portion of the premises shall be used for residential purposes, the owner shall have the privilege of separating the water service so that the residential portion of the premises is served through a separate meter, and in such case, the water usage as registered by the water meter serving such portion of the premises used for residential purposes would qualify under the sprinkling rate.
