(A) The following procedure shall apply to utility disconnections due to delinquent accounts.
(1) The office of the Clerk- Treasurer shall provide notice to delinquent customers via USPS and/or email on accounts that are delinquent on the day that late penalties are incurred. The notice shall also inform the customer that they are entitled to an opportunity to request to be heard by the Council at its next regularly scheduled meeting, before water service is actually disconnected. The Council will make a determination on disconnection after hearing the customer’s reason for late or non-payment.
(2) In the event that the customer does not request the opportunity to be heard by the Council, and does not pay the amount due by the statement date, the town shall take actions to disconnect that water service.
(B) The following procedure shall apply to utility disconnections requested by the customer.
(1) A customer may request that water and/or sewer services be disconnected by the town during normal business hours of the Municipal Office until one hour prior to the normally scheduled closing time of the office. No fee shall be assessed for a requested disconnection which takes place during these business hours.
(2) A customer may request that water and/or sewer services be disconnected by the town outside of normal business hours of the Municipal Office. A fee in the amount of $50 may be assessed for a requested disconnection that takes place outside of the hours listed in division (B)(1).
(3) Notwithstanding any other provisions, the fee described in § 51.09(K) for re- connections shall apply in all cases in which the disconnection was requested by the customer.
