The procedure for the preparation and review of a preliminary plat for final approval requires approval as follows.
(A) Filing.
(1) The preliminary plat shall comply with the provisions of the Subdivision Control Act.
(2) The preliminary plat for final approval shall conform substantially to the preliminary plat for tentative approval as approved and it may constitute only that portion of the approved preliminary plat which the proprietor proposes to record and develop at the time; provided, however, that such portion conforms to this chapter. The preliminary plat for final approval shall show the actual geometries and dimensions of the streets and shall either show exact lot dimensions or show approximate lot dimensions which shall not be decreased on the final plat.
(3) Five copies of the preliminary plat for final approval of the proposed subdivision, together with written application in triplicate, shall be submitted to the Village Clerk at least 14 days prior to the regular Village Council meeting (which meeting shall be considered as the date of filing).
(4) The Village Clerk shall check the proposed plat for completeness. Should any of the data required in the Subdivision Act, or § 153.042, be omitted, the Clerk shall be directed to inform the proprietor of the data required, and that the application will be delayed until the required data is received.
(5) The Village Clerk shall transmit a copy of the valid and complete preliminary plat to the Village Planning and Zoning Board for technical review and recommendation.
(B) Village Planning and Zoning Board review - preliminary plat final approval.
(1) The Village Clerk shall place the preliminary plat on the next regular Village Planning and Zoning Board agenda, at which meeting the proprietor will be scheduled to appear. The Planning and Zoning Board shall act on the preliminary plat within 45 days after the date of filing unless the proprietor agrees to an extension, in writing.
(2) It shall be the duty of the Clerk to send a notice by registered or certified mail to the owners of land immediately adjoining the property to be platted of the presentment of the preliminary plat and the time and place of the meeting of the Planning and Zoning Board to consider said preliminary plat; said notice shall be sent not less than five days before the date fixed therefor.
(3) The preliminary plat for final approval shall be reviewed by the Planning and Zoning Board as to conformity with the approved tentative preliminary plat and plans for utilities and other improvements.
(4) The preliminary plat for final approval documents shall be reviewed by the Planning and Zoning Board as to conformity with the approved tentative preliminary plat and compliance with the requirements of this chapter.
(5) Should the Planning and Zoning Board find that the preliminary plat for final approval is in satisfactory conformance with the tentative preliminary plat and with the requirements of this chapter, it shall approve same and notify the Village Clerk of this action in its official minutes and forward the same, together with all accompanying data, to the Village Clerk for review by the Village Council.
(6) Should the Planning and Zoning Board find that the preliminary plat for final approval does not conform satisfactorily to the previously approved tentative preliminary plat or with the requirements of this chapter, and that it is not acceptable, it shall record the reason in its official minutes and forward same together, with all accompanying data to the Village Clerk; and recommend that the village disapprove the preliminary plat until the objections causing disapproval have been changed to meet the approval of the Planning and Zoning Board.
(C) Village Council - preliminary plat final approval.
(1) The Village Council will not review a preliminary plat for final approval until it has received the review and recommendations of the Planning Commission. Following the receipt of such recommendations, the Village Council shall consider the preliminary plat at such meeting that the matter is placed on the regularly scheduled agenda. The Village Council shall take action on the preliminary plat within 45 days of the date of the initial filing of the plat with the Clerk, as required in division (B)(1) above.
(2) Should the governing body approve the preliminary plat, it shall record its approval on the plat and return one copy to the proprietor.
(3) Final approval of the preliminary plat shall not constitute final approval of the plat.
(4) (a) Final approval of the preliminary plat by the Village Council shall be effective for a period of 12 months.
(b) Should the preliminary plat, in whole or in part, not be submitted for final plat approval within the time limit, the preliminary plat must again be submitted to the Planning Commission and Village Council for approval unless an extension is applied for by the proprietor, and such request is granted in writing by the Village Council.
