(A) Initiation. Village becomes aware of a dangerous structure as a result of:
(1) A written complaint; or
(2) Observation by a village official.
(B) First step. At the first meeting after receipt of divisions (A)(1) or (A)(2) above, the complaint is assigned a complaint number by the Village Clerk and the complaint is placed on the agenda. If the Council members desire to take action against the complaint, they pass a motion to send notice in accordance with § 150.02. If it is the belief on the part of the Village Council that inspection is necessary under § 150.03, then the letter will also request that the owner or occupant consent to have the village’s designated, qualified Inspector enter the structure and submit a written report within 30 days. No action by the owner or occupant other than the consent to inspect will be required until after the receipt of the report and determination by the village of what remedial action is necessary. At that time the owner will have 30 days to remedy the unsafe condition.
(C) Second step. If no action is taken by owner or occupant within the 30-day period, the village will assess a first step fine of $75 and require the owner or occupant to appear at the next regularly scheduled village meeting.
(D) Third step. If no action is taken by owner or occupant under division (C) above, the village will assess an additional fine of $150. Additional fines will be assessed in accordance with the following schedule:
(1) Step three fine: $300; or
(2) Step four fine: $500.
(E) Step six. If no action to remedy the unsafe condition has been taken within 30 days of step five above, the Village Council will take up an abatement by village under § 150.04.
