§ 70.22 NONCITATION OF VIOLATIONS WHEN REQUIRED SIGNS, SIGNALS OR MARKINGS ARE NOT PRESENT.
   (A)   No person shall be cited nor subject to penalties for the violation of any town traffic regulation whenever:
      (1)   Proper signs, signals or markings are required to be maintained indicating the regulation pursuant to § 70.07 and in accordance with I.C. 9-21-1-3 or another statute; and
      (2)   The sign, signal or marking is not present or is not reasonably visible or decipherable.
   (B)   This section does not affect enforcement of state prima facie speed limits, illegal parking in areas which are generally defined by law and wherein parking is prohibited by statute, nor enforcement of other general statutory traffic regulations which are presumed to be known to drivers irrespective of the presence of signs.
