Whereas I.C. 8-1.5-3-3 requires that a municipality operating a municipally owned utility prescribe by ordinance who shall constitute the governing body of the utility, the Town Council is designated ex officio as the governing body of the water utility of the Town of Akron. All references in statutes or ordinances to such governing body or a "Utility Service Board" shall be construed as references to the Town Council in respect to the municipal water utility.
