§ 51.089 METERED WATER USERS.
   (A)   Minimum monthly sewage charge; general users. Except when a higher charge would apply under divisions (B) through (E) of this section, as applicable, the minimum charge for sewage service, where the user is a metered water consumers shall be based upon the meter size as follows.

   (B)   Monthly sewage rates based on water consumption; general users. Except where a higher charge would apply under division (A) of this section, or except as otherwise provided under divisions (C) through (E) of this section and §§ 51.090 and 51.091, sewage service rates, based upon the amount of water used, shall be as follows.

   (C)   Multiple residential or domestic users on single water meter; determination and distribution of charges. In the event that multiple dwellings or residential properties are discharging sanitary sewage, water or other liquids into the town's sanitary sewage system, either directly or indirectly, and are users of water and the quantity of water is measured by a single water meter, then in such case, for billing purposes, the applicable sewage charges shall be determined as follows:
      (1)   Two or more residential lots, parcels of real estate or buildings. In this case, the quantity of water used shall be averaged for each user and the minimum charge under division (A) of this section and the sewage rates aud charges under division (B) of this section shall apply to each of the number of residential lots, parcels of real estate or buildings served through the single water meter.
      (2)   Apartments, housekeeping rooms, trailer parks and the like. In the case of apartment buildings, housekeeping establishments, trailer parks and the like having two or more dwelling units, the charge shall be computed in accordance with divisions (A) and (B) of this section except that the minimum monthly billing shall be computed by multiplying the monthly charge of $27.08 by the number of dwelling units served through the single meter. A dwelling unit shall be interpreted as a room or any other space in which cooking facilities are provided.

   (D)   Sprinkling adjustment for domestic users during summer months. In order that domestic and residential users of sewage services shall not be penalized for sprinkling lawns during the summer months of May, June, July and August, the billing for sewage services for residential and/or domestic users for the months shall be based upon the average water usage for previous months of December, January, February and March, if such usage is lower than the summer months. The sprinkling rate shall not apply to any premises which are partially or wholly used for commercial or industrial purposes. In the event a portion of the premises shall be used for commercial or industrial purposes, the owner shall have the privilege of separating the water service so that the residential portion of the premises is served through a separate water meter, and in such case the water usage as registered by the water meter serving the portion of the premises used for residential purposes would qualify under the sprinkling rate.

   (E)   Premises also discharging sewage derived from unmetered water sources; determination of water usage for sewage purposes. In the event a lot, parcel of real estate or building discharging sanitary sewage, industrial waste, water or other liquids into the town's sanitary sewage system, either directly or indirectly, is a user of water supplied by the water utility serving the town and in addition uses water from another source which is not measured by a water meter or is measured by a water meter not acceptable to the town, then the amount of water used shall be otherwise measured or determined by the town in order to ascertain the rates of charge applicable under divisions (A) through (D) of this section, or the owner or other interested patty, at his or her expense, may install and maintain meters, weirs, volumetric measuring devices or any adequate and approved method of measurement acceptable to the town for the determination of sewage discharge.

   (F)   Rate adjustment for water not discharged to sewage system; determination of sewage volume for rate purposes. In the event a lot, parcel of real estate or building discharges sanitary sewage, industrial waste, water or other liquids into the town's sanitary sewage system, either directly or indirectly, and uses water in excess of 30,000 gallons per quarter, and it can be shown to the satisfaction of the town that a portion of water as measured by the water meter or meters does not and cannot enter the sanitary sewage system, then the owner or other interested patty shall install and maintain meters, weirs, volumetric measuring devices or any adequate and approved method of measurement acceptable to the town for the determination of sewage discharge.
