§ 31.25 PLANTING.
   (A)   Town responsibility. Except as provided in division (B) and §§ 31.26 and 31.27 below, the planting of all street trees shall be done according to the Tree Commission's Town Tree Plan, at the expense of the town, and with permission of the Town Council. Species, spacing and size requirements of § 31.18 and § 31.19.
   (B)   Owner-occupant responsibility.
      (1)   The owner or occupant of property abutting public ways may plant street trees at his or her own expense in accordance with §§ 31.18 and 31.19 above, provided they secure permission from the Tree Commission and/or Town Council.
      (2)   An owner or occupant who gains permission to remove a healthy tree may be required by the Tree Commission to replace that tree. Species, spacing and size requirements of §§ 31.18 and 31.19 must be adhered to.
