2.06.060 Powers and Duties.
Under the supervision of the City Council, and subject to the approval, direction and control thereof, the City Manager shall be responsible for the performance of such duties and ministerial functions as may be placed in his/her charge by the City Council, and in connection therewith, shall report to the City Council from time to time, the status and enforcement of the City Council's policies, rules and regulations. The City Manager shall be the administrative head of the government of the City under the direction and control of the City Council except as otherwise provided in this Chapter. The City Manager shall be responsible for the efficient administration of all affairs of the City, which are under his/her control. In addition to his/her general powers, and not as a limitation thereon, the City Manager shall be expected to and shall have the power to:
   A.   Exercise general control and supervision over the affairs of the City;
   B.   Attend all meetings of the City Council, except when excused therefrom, and advise and make recommendations to the City Council upon matters which are brought before it and which are within his/her administrative authority;
   C.   Subject to rules, regulations, resolutions and ordinances of the City Council, cause to be prepared and submitted requests for the creation of new positions and capital outlay items. He/she may request such information, charts and statistics as may be necessary for his/her recommendations;
   D.   In accordance with Section 901 of the City Charter, prepare and submit the proposed annual budget to the City Council for its approval. Coordinate with all department heads and with the City Treasurer, the preparation of the annual budget and salary plan. In the performance of this duty, the City Manager shall obtain from all department heads the respective departmental budgets, and shall review such budgets including revenues, expenditures and reserves; and he/she shall submit his/her recommendation to the City Council each year at least thirty-five (35) days prior to the beginning of each fiscal year;
   E.   Direct and supervise all the purchasing activities of the City;
   F.   Keep the City Council at all times fully advised as to the financial condition and needs of the City;
   G.   Review all departmental and agency requests for adjustments and transfers of budget funds and make recommendations on them to the City Council;
   H.   Recommend to the City Council adjustments between accounts of the maintenance and operation and capital outlay appropriations of individual City departments, provided that such adjustments do not increase the totals of the amounts budgeted for such categories of expenditures;
   I.   Exercise general supervision over the City Civil Defense activity. The City Manager shall be prepared to recommend the declaration by the City Council of a state of emergency when flood, fire or other disaster warrants such action;
   J.   Maintain continuous research into and study of administrative practices and make recommendations to the City Council concerning such changes or modifications as will improve the efficiency and economy of City government operations;
   K.   Assist committees in the preparation of rules, regulations, forms and accounts, and in connection thereto examine, approve and coordinate development, production and use of general forms by the various departments and agencies;
   L.   Establish and maintain the City's Records and Retention Program;
   M.   Be responsible for the City's insurance policies and act for and on behalf of the City in the recovery of any claims against such policies;
   N.   In cooperation with City departments, prepare and maintain a Municipal Code;
   O.   Promote proper preparation and dissemination of periodic reports and informative pamphlets or brochures;
   P.   Recommend to the City Council new or revised statutes which the City Manager considers to be desirable and merit the endorsement of the City Council. The City Manager shall also recommend to the City Council the adoption of new or revised ordinances and resolutions when in his/her judgment such action will promote improved City services and operations and are in the public interest;
   Q.   Enforce all laws and ordinances of the City and see that all franchises, permits, contracts and privileges granted or approved by the City are faithfully performed and observed;
   R.   Investigate all complaints in relation to matter(s) concerning the administration of the City;
   S.   Exercise general supervision over all public buildings, public parks and other public property which are under the control and jurisdiction of the City Council and not specifically delegated to another board, commission or officer;
   T.   Establish, when not in conflict with the Personnel Rules and Regulations, such other procedures as the City Manager deems necessary for the control and supervision of the affairs of the City and to implement those rules;
   U.   Consistent with the City's Personnel Rules and Regulations (and applicable state and federal laws and court decisions) appoint, transfer, promote, demote, reinstate, lay off, suspend or dismiss City employees for whom the City Manager is the appointing authority. The City Manager shall be the appointing authority for every full time, part time, seasonal or other employee except the position of the City Attorney. The City Manager shall be the Personnel Officer and with the approval of the City Council may delegate such duties to his/her assistants;
   V.   Provide leadership for civic activities designated to benefit the residents of the City when so authorized by the City Council;
   W.   Supervise and coordinate necessary investigations, studies and surveys;
   X.   Coordinate the work of other City departments. The City Manager may require periodic submission of organization charts and departmental activity reports, and shall inform departments of actions, decisions and policies of the City council affecting departmental operations;
   Y.   Hire employees who shall not be covered by or entitled to the benefits of the City's Personnel Rules and Regulations for a definite term not to exceed six (6) months to perform temporary duties; and
   Z.   Perform such other duties and responsibilities and exercise such other powers as may be delegated from time to time by ordinance or resolution or other official action of the City Council.
