Consistent with state law and subject to the exceptions listed below, if the massage establishment only uses massage therapists certified pursuant to the procedures outlined in California Business and Professions Code §§ 4600 et seq., then the massage establishment shall be exempt from the requirements of this Chapter. However, such massage establishments are subject to the following requirements:
A. Massage establishments must file the certificates for all state certified massage therapists with the City.
B. Massage establishments are required to obtain and pay for a business license, the City is allowed to investigate the information provided, and the City is allowed to deny or restrict a business license if the applicant has provided materially false information.
D. The City retains the right to conduct reasonable inspections, during regular business hours, to ensure compliance with state and local law or other applicable fire and health and safety requirements.
E. The massage establishment is required to notify the City of any intention to rename, change management, or convey the business to another person or entity.
F. All applicable zoning and land use regulations are applicable to all massage establishments.
If and when Business and Professions Code §§ 4600 et seq. and the rules therein are repealed, this Section 5.60.520 is correspondingly also repealed and Chapter 5.60 of the Adelanto Municipal Code shall be applicable to all massage establishments within the City.
