No person, firm or corporation shall engage in the establishment, operation or maintenance of a place described in Section 721.01 hereof, or suffer the same to exist on property in whole or part owned by him with the present right of occupancy, unless there is erected and maintained completely around the same a nontransparent metal fence at least eight feet high and beginning at the surface of the ground and so constructed to prevent the deposit within, through or under such fence, of any garbage or household refuse at any place from the surface of the ground to the top thereof, and completely encircling such place or places, including a similarly nontransparent and restricting gate or gates, which shall remain closed and locked at all times when an owner or employee of such establishment shall not be in attendance. Such fence and gates shall be neatly kept plumb and even, without holes or rust, and free of all advertising save only the name of the business operated within.
