§ 113.01 PERMIT REQUIREMENTS.
   (A)   Owners and operators of horse-drawn carriage businesses shall apply to the Clerk-Treasurer of the town for a permit to use the public way, using designated application forms provided by the Clerk-Treasurer. These forms shall set forth the owner-operator’s proposed routes for the company’s carriages, hours of operation, the type of vehicle, to be used and shall be signed by both the owner of the carriages and/or business and the operator of said business.
   (B)   In addition to the other requirements of this chapter, all applications for permits required by this section shall contain the following information:
      (1)   The number of carriages to be licensed;
      (2)   Seating capacity and name of manufacturer of the carriage;
      (3)   A brief financial statement concerning the applicant including the type of business entity (i.e., partnership, corporation) which owns the business;
      (4)   Whether the applicant has ever been convicted of a felony, if the applicant is an individual; whether any of the partners have ever been convicted of a felony, if the application is a partnership; and whether any of the officers or directors have been convicted of a felony, if the applicant is a corporation;
      (5)   The name of all persons other than the applicant who have any financial interest in any of the carriages or other property to be used in the business; and
      (6)   Applicable phone numbers of the business and emergency phone numbers where the owners and/or operators can be reached in the event of an emergency.
   (C)   The Town Council shall set and approve all carriage routes as well as operating times with due consideration of public health and safety and all permit applications submitted to the Clerk-Treasurer shall be referred to the Town Council for approval of routes and times. The town specifically limits to four the number of permits to be issued and in effect at any one point in time.
   (D)   Permits shall cost annually the sum of $50 per carriage. Said permits may be renewed annually upon written application in the same form and substance as contained in the initial application.
