§ 111.08 LIABILITY, INDEMNIFICATION AND INSURANCE.
   (A)   The operator shall indemnify the town for all expenses and costs, including attorneys’ fees and other out-of-pocket expenses, arising out of or resulting from the grant of authority under this chapter to the operator.
   (B)   The operator shall pay all damages and penalties which the town may legally be required to pay as a result of the grant of authority to operator under this chapter, including all damages arising out of the installation, operation or maintenance of the cable television system, whether or not any act or omission complained of is authorized, allowed or prohibited under this chapter.
   (C)   The operator shall indemnify, protect and save harmless the town against losses and physical damage to property, bodily injury or death to persons, including payments made under any worker’s compensation laws. The company shall carry insurance to protect itself, the utility companies and the town from and against all claims, demands, actions, judgments, costs, expenses and liabilities which may arise or result, directly or indirectly, from or by reason of such loss, injury or damages. Such insurance policies shall specifically provide that the town and utility be shown as named insureds. The amounts of such insurance against liability due to physical damage to property shall be no less than $50,000 as to any one claim and not less than $200,000 aggregate in any single policy year. The amounts of insurance against liability due to bodily injury or to death of persons shall be not less than $100,000 as to any one person or occurrence and not less than $300,000 as to all such claims arising from any one accident; provided that, the operator shall carry a minimum of $1,000,000 umbrella coverage as further protection for the operator, utilities and town. All insurance required by this chapter shall be and remain in full force and effect for the entire period of this chapter. The policies of insurance, or a certificate copy of insurance, shall be deposited with and kept on file by the town in the office of the Clerk- Treasurer.
