§ 34.17 SMALL BUSINESS SET-ASIDE PURCHASES.
   (A)   General. The Town Council hereby determines to establish criteria for determining qualifications as a small business in anticipation that from time to time certain supplies will be identified and designated for purchase from small businesses pursuant to I.C. 5-22-14 dealing with small business set-aside purchases.
   (B)   Qualifications.
      (1)   A business qualifies as a small business if it qualifies as a small business under standards established by the State Department of Commerce.
      (2)   The following businesses are not eligible for the town’s small business set-aside:
         (a)   A wholesale business, if its average annual sales for its most recently completed fiscal year exceeds $4,000,000;
         (b)   A construction business, if its average annual receipts for the preceding three fiscal year exceeds $4,000,000;
         (c)   A retail business or business selling services, if its annual sales and receipts exceed $500,000; and
         (d)   A manufacturing business, if it employees more than 100 persons.
