(A) Franchise. The town hereby gives and grants to the operator the non-exclusive right, privilege, authority, license and franchise to use the public ways of the town for and in the territory or areas contained in this chapter, for the purpose of constructing, operating and maintaining a cable television system during the term and under the provisions of this chapter.
(B) Public utility pole use. The operator shall have the right, privilege and authority to lease, rent or in any other manner obtain the use of towers, poles, lines, cables and other equipment and facilities from any and all holders of public utility licenses, easements, rights-of-way and franchises within the corporate limits of the town, subject to any and all existing and future ordinances enacted by the town. It is the intention of the town that all holders of public licenses, easements, rights-of-way and franchises within the town shall cooperate in making available to the operator poles and pole line facilities wherever and whenever possible and wherever such use does not interfere with the normal use and operation of said poles and pole lines by the owners thereof. The owner shall have the right to erect, install and maintain its own towers, poles, guys, anchors and ducts as may be necessary for the proper construction and maintenance of the system; provided that, poles placed on public easements and rights-of-way shall first have their location approved by the Council.
(C) Operation. The operator shall, during the term of the franchise, furnish reasonable, adequate and efficient television service to its subscribers and agrees to maintain its system in good repair and working order and to provide adequate facilities for such maintenance. In addition, the operator itself shall operate the system as to not interfere with the direct broadcast reception of other signals, whether television, radio or otherwise, or with the transmission of telephone and telegraph signals, or with the distribution of electric or electronic signals or energy by others, whether by air, wire, cable, conduit or otherwise.
