The permit holder shall guarantee the survival of each tree planted within the rights-of-way of any public street, alley or way for one year after the planting date. Any tree not surviving for one year shall be placed, either by the permit holder or by the town, at the permit holder’s expense, or removed by the town at the town’s expense. After a period of one year, the permit holder shall be relieved of the survival guarantee, and all flora planted within the rights-of-way of any public street, alley or way shall become the property of the town, which shall have complete and continued authority to ensure that all terms and conditions set forth in this chapter are maintained.
