§ 100.03 PERMIT REQUIRED.
   (A)   No person shall plant any flora on or in any portion of a public right-of-way, street, alley or way within the town unless the Director shall have first reviewed the proposal with the town of the Street Department and Parks and Recreation Department, and approved the kind or variety thereof, designated the location therefor and granted a permit for such planting.
   (B)   The permit obtained for the above noted planting shall be one of the following:
      (1)   Consent to encroachment: required for any planting of trees or flora within public rights-of-way or public land (§ 100.09 of this chapter); or
      (2)   Obstruction of recorded easement: required for the installation of any encroachment in a recorded and platted easement which runs in favor of the town (§ 100.10 of this chapter).
