The Town Council specifically acknowledges the existence of House Enrolled Act 1467 ("Act") adopted by the General Assembly of the State of Indiana which regulates the imposition of impact fee ordinances by municipal corporations within the State of Indiana. It is the intent of the town to comply with the Act, and this subchapter shall be construed in all respects to be consistent with the Act. The substantive and procedural requirements of I.C. 36-7-4-1300 et seq. shall control in the event of conflicts between this subchapter and the Act, which conflicts are unintended by the Town Council.
