Pursuant to I.C. 36-7-4-1325, on the date of issuance of an improvement location permit, the town acquires a lien against the real estate on which the impact fee is assessed. The town may, in its discretion, file a specific instrument setting forth its lien rights with respect to a parcel of real estate which is the subject of an installment payment of an impact fee, and such instrument shall constitute actual notice in addition to the constructive notice provided for by the recording of this subchapter.
