§ 93.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   (1)   A person who smokes or uses tobacco in an area where smoking and tobacco are prohibited by the provisions of §§ 93.01 through 93.12 of this chapter shall be guilty of an infraction, punishable by a fine not exceeding $250 per infraction.
      (2)   A person who owns, manages, operates or controls a public place or place of employment and who fails to comply with the provisions of §§ 93.01 through 93.12 of this chapter shall be guilty of an infraction, punishable by:
         (a)   A fine not exceeding $100 for a first violation;
         (b)   A fine not exceeding $200 for a second violation within one year of the first violation; and
         (c)   A fine not exceeding $500 for each additional violation after the second within one year.
      (3)   Each day on which a violation of §§ 93.01 through 93.12 of this chapter occurs shall be considered a separate and distinct violation.
