The prohibitions of § 93.04 of this chapter shall not apply to the following:
(A) Private residences, except when used as a licensed childcare, adult day care or health care facility;
(B) Hotel and motel rooms that are rented to guests and are designated as smoking rooms;
(C) Designated rooms in nursing homes and other long-term care facilities in which residents only may smoke; and
(D) Except as noted in § 93.03 above, any outdoor area.
