§ 52.065 DEFINITIONS.
   For the purpose of this subchapter, the following definitions apply unless the context clearly indicates or requires a different meaning.
   BOD or BIOCHEMICAL OXYGEN DEMAND. The same meaning as defined in § 52.015 of this chapter.
   COUNCIL. The Town Council of the Town of Zionsville, Indiana, or any duly authorized officials acting in its behalf.
   DEBT SERVICE COSTS. The average annual principal and interest payments on all outstanding revenue bond or other long-term capital debt.
   DWELLING UNIT.
      (1)   A room or group of rooms designed and equipped exclusively for use as living quarters for only one family and its household employees, including eating, lawful cooking, sleeping space and sanitary facilities reserved solely for the occupants thereof.
      (2)   The term shall include MOBILE DWELLINGS, MODULAR DWELLINGS and MANUFACTURED DWELLING (as those terms are defined in the town’s zoning ordinance), but shall not include recreational vehicles.
   EXCESSIVE STRENGTH SURCHARGE. An additional charge which is billed to users for treating sewage wastes with an average strength in excess of normal domestic sewage.
   MUNICIPAL SEWAGE WORKS. The sewage works owned and operated by the town.
   NON-RESIDENTIAL USER. All other users of sewage services provided by the sewage works.
   NORMAL DOMESTIC SEWAGE.
      (1)   For the purpose of determining surcharges, wastewater or sewage having an average concentration as follows:
         (a)   BOD not more than 220 mg/l;
         (b)   S.S. not more than 220 mg/l;
         (c)   Nitrogen ammonia (“NH-N”) not more than 15 mg/l; and
         (d)   Total phosphorous (“P”) not more than two mg/l.
      (2)   As defined by origin, wastewaters from segregated domestic and/or sanitary conveniences as distinct from wastes from industrial processes.
   NPDES (NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM) PERMIT. The same meaning as defined in § 52.015 of this chapter.
   OPERATION AND MAINTENANCE COSTS. Includes all costs, direct and indirect, necessary to provide adequate wastewater collection, transport and treatment on a continuing basis and produce discharges to receiving waters that conform with all related federal, state and local requirements. (These costs include replacement.)
   OTHER SERVICE CHARGES. Tap charges, connection charges, area charges and other identifiable charges other than user charges, debt service charges and excessive strength surcharges.
   PERSON. Any and all persons, natural or artificial, including any individual, firm, company, municipal or private corporation, association, society, institution, enterprise, governmental agency or other entity.
   REPLACEMENT COSTS. The expenditures for obtaining and installing equipment, accessories or appurtenances which are necessary during the useful life of the treatment works to maintain the capacity and performance for which such works were designed and constructed.
   RESIDENTIAL USER. A user of sewage services provided by the sewage works, which service is only utilized by one dwelling unit.
   S.S. or SUSPENDED SOLIDS. The same meaning as defined in § 52.015 of this chapter.
   SHALL. The act referred to is mandatory; MAY is permissive.
   SEWAGE. The same meaning as defined in § 52.015 of this chapter.
   SEWER USE ORDINANCE. A separate and companion enactment to this chapter, which regulates the connection to and use of public and private sewers. This ordinance is codified as §§ 52.015 through 52.030 of this chapter.
   TOWN. The Town of Zionsville, Indiana, acting by and through the Town Council.
   USER CHARGE. A charge levied on users of the municipal sewage works for the cost of operation and maintenance of the same, pursuant to § 204(b) of the Federal Water Pollution Control Act of 1972, Pub. Law No. 92-500, 86 Stat. 835.
   USER CLASS. The division of municipal sewage works customers by source, function, waste characteristics and process or discharge similarities (i.e., residential and non-residential in the user charge system).
