§ 50.40 RATES AND CHARGES ESTABLISHED.
   The Department is operated as an enterprise fund. There are hereby fixed and prescribed monthly rates and charges (herein sometimes called the service charges) for the service and facilities furnished and to be furnished by the Department for collection and disposal of solid waste to be paid by the owner, tenant, or occupant of each premise or parcel of land which shall use or be served by such services and facilities, which rates and charges shall be payable monthly for services rendered as follows:
   (A)   Residential dwellings.
      (1)   Effective October 1, 2019, through September 30, 2020, for residential units where the solid waste is collected curbside in individual containers, the rate shall be $11.89 per month for each residential unit. Beginning October 1, 2019, and each year thereafter, the rate shall be adjusted pursuant to division (D) of this section.
      (2)   Beginning October 1, 2007, for residential units where the solid waste is collected curbside in individual containers, a $15.00 turn-on fee shall be charged when service is initiated and a $15.00 turn-off fee shall be charged when service is stopped.
      (3)   Effective October 1, 2018, through September 30, 2019, for master meter customers, the rate shall be $8.23 per month per residential unit. Beginning October 1, 2008, and each year thereafter, the rate shall be adjusted pursuant to division (D) of this section.
      (4)   Missing containers/carts or those severely damaged beyond repair shall be replaced at the owner/occupant’s expense. The owner/occupant shall incur a $60.00 replacement fee to cover the cost of the container, delivery and processing. This applies to both residential and commercial customers.
      (5)   Stolen carts shall require the owner to submit a stolen cart form to the Police Department for investigation and assignment of a case number. The Police Department will then forward the complete form to the Sanitation Department for cart replacement at the city’s expense. This applies to both residential and commercial customers.
   (B)   Commercial.
      (1)   Effective October 1, 2019, through September 30, 2020, for commercial premises where the solid waste is collected curbside in individual containers, the rate shall be $13.72 per month for each business unit. Beginning October 1, 2019, and each year thereafter, the rate shall be adjusted pursuant to division (D) of this section.
      (2)   Effective October 1, 2019, through September 30, 2020, for commercial premises served by refuse bins or dumpsters, the rate shall be the greater of $13.72 per month per business unit served, or a monthly rate based on the volume of the refuse bin in cubic yards and the frequency of collection per week as noted below. Beginning October 1, 2019, and each year thereafter, the rates shall be adjusted pursuant to division (D) of this section. The following monthly rates shall apply from October 1, 2019, through September 30, 2020:

      (3)   The city may require the use of dumpsters in lieu of conventional garbage cans for other than single family residential use.
      (4)   The number of pi+ckups required by users, together with requirement as to container size and capacity for dumpsters, shall be determined by the Director.
      (5)   For the installation of new containers, it is the responsibility of the customer to provide adequate access and a dumpster enclosure approved by the Director, as set forth in § 50.26(B).
      (6)   There shall be a charge of $25.00 for delivering, removing, exchanging or placing a dumpster for users.
      (7)   An additional charge of $12.00 per cubic yard times the size of the refuse bin shall be made for extra trips or pick-ups, or return trips due to over-spillage.
      (8)   Refunds. There shall be no refund of any service charge prescribed herein on account of partial vacancy.
      (9)   There may be a refund of service charges, not to exceed charges assessed for a one year period, for total vacancy of the premises provided that the owner of the premises requests the refund from the Department in writing and the Department determines that no service has been rendered from the premises for the period for which the refund is requested. No refunds or credits are authorized for partial vacancies for 60 days or less.
      (10)   Free service. There shall be no free services rendered by the Department for the collection, transportation or disposal of solid waste.
      (11)   Deposit. For commercial accounts, a deposit for solid waste services will be charged equal to two times the monthly service charge. That deposit level must be maintained at all times.
   (C)   Special services.
      (1)   The term “special services” shall include, but not be limited to, the collection of yard trash in excess of six cubic yards per month; the collection of junk, bulky waste, white goods, or rubbish not placed within containers or refuse bins; or the collection of yard trash, junk, bulky waste, white goods, or rubbish from lots or property not paying a monthly fee for collection services.
      (2)   The additional charge for special services shall be $200 per hour, billed in quarter hour increments, plus the actual disposal charge.
   (D)   Rate adjustments.
      (1)   Adjustments. On October 1, 2019, and on October 1 of each subsequent year, the rate schedules provided in divisions (A) and (B) of this section shall be escalated in accordance with the Consumer Price Index for all Urban Consumers (CPI-U): South Urban, All Items (unadjusted). In no event shall the base rates be adjusted downwards absent affirmative action by the City Council.
      (2)   Any rate schedule adjustments, other than that provided for in division (D)(1) of this section, shall be made only upon authorization by the City Council. A public hearing shall be had by the City Council regarding such change in the rate schedule, and notice of such public hearing shall be duly published at least 15 days prior to the date of such public hearing.
