Any violation of this subchapter shall constitute a Class 5 violation, pursuant to the city Uniform Fine Schedule. Any use in violation of this subchapter which has been in continuous and open use since January 1, 1979 may apply for non-conforming use status for a period of 90 days from the time the notice of violation was issued pursuant to 12.01.04.02 of the Land Development Code, as amended.
