509.08 MINORS' CURFEW.
   (a)   No minor under the age of thirteen years shall loiter, idle, wander, stroll or play in or upon the public streets, other public places, places of amusement and entertainment, vacant lots, vacant houses or other unsupervised places during the period from 10:00 p.m. to 5:00 a.m. of the following day.
   (b)   No minor thirteen years or older shall loiter, idle, wander, stroll or play in or upon the public streets, other public places of amusement and entertainment, vacant lots, vacant houses or other unsupervised places, between the hours of midnight to 5:00 a.m. of the following day.
   (c)   The provisions of subsections (a) and (b) hereof do not apply to minors accompanied by a parent, guardian or other adult person having legal or authorized care, custody and control of the minor or where the minor is upon an emergency errand, or legitimate business directed by his or her parent, guardian or other adult person having legal or authorized care, custody and control of the minor.
   (d)   Any minor found violating subsection (a) or (b) hereof shall be given a written first offense warning, which shall notify the minor, parents or other custodian of the minor of the penalties which may be imposed for a subsequent violation.
   (e)   Any minor found violating subsection (a) or (b) hereof, having previously been issued a first offense warning, shall be charged with curfew violation.
   (f)   No person having legal custody and control of any minor shall negligently permit the minor to violate the provisions of this section after having received a first offense warning, as provided in subsection (d) hereof.
   (g)   Whoever violates subsection (f) hereof if guilty of a minor misdemeanor.
   (h)   This curfew shall be enforced in strict conformity and compliance with the Ohio Rules of Juvenile Procedure and Ohio R.C. 307.71.
