§ 139-099  Penalty.
   (A)   Unless otherwise provided for herein, it shall be unlawful for any person, firm, or corporation to violate, or cause the violation of, any provision of this chapter. Any person, firm, or corporation violating any of the provisions in this chapter shall be guilty of a class three misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed $500 or by imprisonment for not more than one day or both fine and imprisonment.
   (B)   Each separate day or part thereof during which any violation of this chapter occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided. Notwithstanding the foregoing, the unauthorized use of permissible consumer fireworks only shall be deemed a petty offense and punishable by a fine not to exceed $500.
