§ 139-003 Firework Displays; Permit Required.
   (A)   In order for a firework display to be lawfully conducted within city limits, a permit shall be obtained from the City of Yuma Fire Department. No permit shall issue until the Fire Chief, or designee, investigates, assesses, and approves the operator, location, and plan for the handling of the firework display.
   (B)   The Fire Chief, or designee, shall ensure compliance with the City of Yuma Fire Code and the NFPA 1123, Code of Firework Display, both as amended.
   (C)   An application for a public firework display shall be submitted in writing not less than fourteen (14) business days prior to the date of the intended use. Applications shall be reviewed and investigated in the order received.
   (D)   Every firework display shall be handled by a competent operator and shall be of such a character, and located, discharged and/or fired in such a manner as to not be hazardous to or endanger any person or property.
   (E)   The Fire Chief, or designee, has the authority to place reasonable limitations on the issuance of permits in order to protect the safety of persons and property and to comply with laws and regulations.
   (F)   Each permittee shall pay a bond in an amount not less than five hundred dollars ($500.00), conditioned upon payment of all potential damages to persons and/or property by reason of the use or discharge of the fireworks.
   (G)   Permits may be denied, revoked, or suspended in the event a federal or state agency implements a Stage 1 or higher fire restriction.
   (H)   The display shall comply with the plan approved by the Fire Chief, or designee, and the plan shall not be modified without Fire Department approval. Any deviation from the approved plan without further approval may result in permit revocation and civil sanctions.
   (I)   After the issuance of a permit, the possession and use of fireworks shall be lawful for that permitted purpose and time period only.
   (J)   No permit is transferable or assignable.
   (K)   Permit applications may be denied based on prior violations of this chapter.
