6.04.050: ADMINISTRATIVE HEARING TO CONFIRM NUISANCE:
Original notice as provided in section 6.04.040 of this chapter shall also state application may be made within ten (10) days of notification for a hearing before the hearing officer to determine whether the structure or property is a public nuisance and whether the action demanded in said notice is necessary to comply with the requirements of this chapter. Application for a hearing must be made in writing within the said time to the town manager and, upon receipt of a sufficient signed application, the town manager shall set a hearing and notify the applicant thereof by mail to the address set forth in the application. This notice shall name the date for hearing, and said hearing shall be held not less than ten (10) days from giving notice thereof if the owner resides within the town of Yucca Valley, or thirty (30) days if the owner resides outside of the town of Yucca Valley except by agreement of the applicant and the town manager, with consent of the hearing officer if he has been appointed.
