5.22.440   Criminal penalties.
A.   Any person who violates, causes, maintains, or permits another person to violate any provision of this chapter shall be guilty of a misdemeanor, however the city attorney may specify in accusatory pleadings that the offense shall be an infraction. Any person convicted of an infraction shall be subject to a fine to the maximum amount permitted by state law. Any person convicted of a misdemeanor shall be subject to punishment to the maximum permitted by state law. The conviction and punishment of any person in violation of this code shall not excuse or exempt such person from the payment of any license fees or penalties due or unpaid at the time of such conviction.
B.   Pursuant to Government Code Section 36900(a), the city attorney may prosecute these violations in the name of the people of the State of California.
