DEVELOPMENT CODE
13.04.130   Affirmative defense.
A discharger shall have an affirmative defense in any action brought against it alleging a violation of Section 13.04.090 where the discharger can demonstrate it did not know or have reason to know that its discharge, alone or in conjunction with a discharge or discharges from other sources would cause violation of the municipal NPDES stormwater permit. (Ord. 229 § 3, 2005)
