No person shall conduct food truck activities within the city without first obtaining an itinerant vendor permit issued pursuant to the requirements set forth in this chapter, except under the following conditions:
A. A special event permit issued pursuant to the requirements set forth in Chapter 5.16 of Title 5 of this code, shall be required when the food truck activity is associated with the operation of a city-permitted special event, subject to the conditions thereof.
B. An itinerant vendor permit issued pursuant to the requirements set forth in this chapter shall not be required when the food truck activity is limited to a single truck on private property with the written authorization of the property owner or lawful lessee/tenant, operating solely for private purposes and when all of the following provisions are met:
1. The truck is parked entirely on paved portions of private property; and
2. Service is limited to the guests of the property owner or lawful lessee/tenant only.
C. The requirements of this chapter shall not apply to any food truck operator at a city event or upon city property with the permission of the city manager, or their designee. The city manager shall ensure that the purposes of this chapter are met by the terms and conditions of any agreement applicable to such food truck operator. (Ord. 444 § 2, 2024)
