§ 152.120 AUTHORIZED WHEN.
   Where the Plan Commission finds that strict compliance with the requirements of this chapter would result in extraordinary or undue hardship to the subdivider or that these conditions would result in retarding the achievement of the objectives of this chapter, then the Plan Commission may, after written application by the subdivider, approve variations or exceptions to the regulations within the limitations and conditions stated in this chapter, provided that such variations or exceptions shall not have the effect of nullifying the intent and purpose of this chapter or the Master Plan.
