§ 152.097 SEWAGE DISPOSAL.
   (A)   Required. A means of sanitary sewage disposal shall be provided for the use of every resident and user of the subdivision in accordance with accepted modern sanitary engineering practice and shall be designed in accordance with the requirements of the County Health Department, the State Board of Health and applicable town ordinances.

   (B)   Requirements. If a subdivision can be reasonably served by the extension of an existing public sanitary sewer, as determined by the Plan Commission, the subdivider or developer shall provide a system of sanitary sewer mains and shall provide lateral connections for each lot. Where a public sanitary sewer is not reasonably accessible, the subdivider, the owner or the developer may provide septic tanks for each lot, provided that such septic tanks are installed in accordance with state and local requirements, and provided that a system of sanitary sewer mains are installed and capped until such time as they can be connected to the public sewer system. Whenever main lines are installed, sewer and water shall be extended to property lines.

   (C)   Individual sewage disposal facilities.
      (1)   In the event the installation of individual disposal systems is considered, the absorption ability of the soil, surface drainage and topography shall be criteria for determining whether or not the installation of individual septic tank disposal systems are feasible.
      (2)   At least two soil borings to a depth of at least four feet shall be made for each acre of land area being platted, and each test and boring shall be numbered and its location shown on the plat.
      (3)   The general types of soil encountered in making tests and borings and the depth of groundwater, if found, shall be documented and submitted with the preliminary plat together with the name and address of the registered engineer and/or surveyor making the test and borings and the date on which they were made.
      (4)   All percolation tests shall be performed in accordance with requirements of the Plan Commission. Requirements should be in line with those as specified in the United States Public Health Service Publication No. 197, “Studies On Household Disposal Systems,” or as specified by the Indiana State Board of Health.
      (5)   Septic tanks and disposal fields shall be installed in accordance with the requirements of the laws of the state.
      (6)   In all cases where it has been determined by the Plan Commission that septic tank disposal systems are not feasible, a group sewage disposal system may be required.
