§ 152.042 TIME LIMITS.
   The Plan Commission shall take final action on all applications that are tentatively approved within 75 days after the meeting at which tentative approval is given or within 45 days after the final plat is submitted, whichever is later. Failure by the Plan Commission to act within such period shall be deemed approval of the subdivision and the Secretary of the Plan Commission shall issue a certificate to that effect upon demand; provided, however, that the Commission may delay any preliminary or final action at the written request of the developer, in which case the provisions of this section shall not apply.
