§ 152.006 APPLICATION FEES.
   (A)   Application fees. At the time of filing an application for approval of a plat, the application shall be accompanied by a certified check or money order of $100, plus $10 for each lot in the proposed subdivision payable to the Town Clerk-Treasurer. Upon the acceptance of the application by the Commission, the Commission Secretary shall surrender the check or money order to the Town Clerk- Treasurer for deposit in the General Fund of the town. The fees required by this section are in addition to any sums paid for review of improvement plans and field inspections as required by other provisions of this chapter.
   (B)   Fee adjustments and refunds. At the time the final plat of the subdivision is submitted, the fee required by division (A) of this section will be recalculated on the basis of the actual number of lots created, and the subdivider will pay an additional amount or receive a refund if the adjusted fee differs from the original fee paid. There shall be no refund of any portion of the fee should the subdivider fail to file a final plat of subdivision. If, because of the failure of the subdivider to file a final plat within the time permitted, it is necessary to resubmit a preliminary plat for tentative approval, the subdivider shall be required to pay, without credit for any fees previously paid, the fee currently in effect at the time of resubmission.
