Refuse collection and disposal service shall be provided by the town by means of entering into a contract with a private operator for such service. Such contract shall require the posting of a performance bond, shall provide that persons contracted with shall have the exclusive right to collect or dispose of any or all refuse pursuant to the provision of I.C. 36-9-30-5, shall not provide for payments to such operator in excess of available revenue from charges authorized under this chapter and shall provide for such other terms and provisions of the refuse disposal act, I.C. 36-9-30-1 et seq.
