§ 50.02 PROVISIONS FOR DISPOSAL.
   (A)   The occupants of any premises where ashes, garbage or trash accumulates shall place all such garbage or trash in a watertight, lidded metal or plastic container equipped with a bail or handles on the outside by which the same may be lifted of not to exceed 30 gallons in capacity and shall place all ashes in a similar container of not to exceed 55 gallons, except that the container need not be lidded or be equipped with a bail or handles. No such container shall weigh in excess of 100 pounds, and the container shall be of such construction as to allow handling by no more than two men with reasonable effort. All garbage shall be so wrapped as to prevent the container from becoming watery or sloppy. Ashes or the residue from any material that has been burned shall not be placed in any container for collection on the day of collection or the day immediately prior to collection.
   (B)   Containers for ashes, garbage or trash shall be placed for collection in accordance with a schedule of pickups as may be determined from time to time by the Town Council. Due notice of any change in the schedule shall be given in advance by the Town Council. Containers for ashes, garbage or trash shall be placed for collection within ten feet of the public alley adjacent to the premises, then such container shall be placed for collection within ten feet of the curb or street line of the public street adjacent to such premises. The container shall be so placed for collection by 10:00 a.m. on the scheduled day of collection.
   (C)   When containers are so placed by the occupants of the premises pursuant to this chapter, the town shall collect and remove, or cause to be collected and removed, the contents thereof according to the schedule of pickups as determined by the Town Council. Ashes, garbage or trash not placed for collection as specifically prescribed by this chapter shall not be collected. All persons shall keep and maintain the alley or street adjacent to their premises free and clear of any such ashes, garbage or trash which may be left thereon.
   (D)   No person shall place or permit to accumulate or remain anywhere in the town any garbage or other material subject to decay other than leaves or grass or any ashes or trash except in a covered or lidded container as herein set out; nor shall any person dump or place or cause to be dumped or placed any ashes, garbage or trash on any premises in the town without the consent in advance of the owner of such premises.
