§ 35.37 CLERK’S RECORD PERPETUATION FUND.
   (A)   The matters and things cited in the preamble to the ordinance set forth in this section are adopted and made a part of this section by incorporation and reference as if repeated in full.
   (B)   The Town Council determines:
      (1)   That a $5 fee shall be assessed to the defendant for production and facsimile transmission of the form to the Bureau of Motor Vehicles;
      (2)   That there shall be established an account to be designated as the Clerk’s Record Perpetuation Fund established for the purpose of collection of the above fee;
      (3)   That the Yorktown Town Court Clerk shall collect this money and deposit the same in the Clerk’s Record Perpetuation Fund which shall be established and controlled by the Clerk-Treasurer’s Office of the town. The fees shall be remitted to the Clerk-Treasurer on a monthly basis;
      (4)   The Clerk’s Record Perpetuation Fund may only be expended after appropriation for contractual services, repairs, maintenance, supplies, purchase of equipment and overall promotion of the Yorktown Town Court’s record keeping and administration. All expenditures from the Clerk’s Record Perpetuation Fund shall be processed, appropriated, claimed and allowed in the same manner as other claims of the Town of Yorktown.
   (C)   The Town Council authorizes the establishment of the Clerk’s Record Perpetuation Fund and collection of fees as herein above stated and for use of the monies accumulated in said Fund for herein above stated reasons, dated July 17, 2000, and authorizes the signature thereon, by the President of this Council and a attestation thereof by the Town Clerk-Treasurer.
