§ 35.31 GUN PERMIT FUND.
   (A)   Sources. The sources of this Fund shall be provided exclusively by the monies received for handgun license applications.
   (B)   Limitation on Fund. In keeping with the provisions of this chapter, the following procedures shall be followed in accounting for this Fund:
      (1)   Issue a receipt, General Form No. 352, for each fee collected;
      (2)   Remit receipts to the Clerk-Treasurer at least once a month;
      (3)   The Clerk-Treasurer shall issue a official receipt for remittance specifying on such receipt the number of general receipts accounted for; (For example: General Receipt Nos. 1 - 8, $40.)
      (4)   The Clerk-Treasurer shall receipt the fees to a separate fund in the ledger of receipts and disbursements titled “Gun Permit Fund” and deposit such receipts in the town’s general corporation bank account;
      (5)   If the application for a handgun license is turned down, a refund shall be made from the Gun Permit Fund without appropriation upon the basis of a claim filed, allowed and paid in the proper legal manner. No refunds for this purpose are to be made from any other fund of the town.
   (C)   The law enforcement agency which accepts an application for a four-year permit will now collect a $10 fee, $5 of which must be refunded if the license is not issued. In addition to the application fee, the fee for a qualified license will increase to $5 and for an unlimited license to $50, $30 of which will be refunded if the license is not issued. For an application from an individual that already possesses a valid Indiana handgun license, the fee is $40, of which $30 shall be refunded if the license is not issued. Retired law enforcement officers having served 20 or more years as an officer may receive a lifetime license and are not required to pay a fee. Such fees are to be deposited in the Law Enforcement Continuing Education Fund. A charge of $5 may be charged by a police agency to process a transfer application ($3 to state, $2 into the Police Department Training Fund).
