11-2-2: EXCEPTIONS; WAIVERS:
The city council may grant an exception or waiver to any of the requirements of this title with respect to a particular development at the time of tentative map approval. Such exception or waiver shall not be granted unless:
   A.   Application: The developer has submitted a written application therefor with the city council prior to report and recommendation on the map.
   B.   Criteria For Approval: The city council finds that each of the following conditions exist:
      1.   There are special conditions or circumstances peculiar to the property justifying the waiver.
      2.   The exception would further one or more of the objectives set forth in section 11-1-2 of this title.
      3.   Such waiver would not in effect nullify the objectives of this title or any other law or ordinance applicable to development.
      4.   Such waiver would not be injurious to adjacent properties or detrimental to the health, safety, convenience and welfare of the public.
   C.   Order Granting Waiver: The order granting the waiver may contain conditions, and failure to conform to such conditions will be grounds for disapproval of the final map of the land development. Such order shall be included in the approval or conditional approval of the tentative map. (1973 Code § 16.28.020)
