8-4-19: TERMINATION:
   A.   Noncompliance With Rules: The department may terminate water and/or sewer service to any customer for violation of these rules after it has given the customer written notice of such intention. (1973 Code § 13.40.070)
   B.   Unsafe Condition: If any condition is found to exist on a customer's premises which constitutes a hazard to health or which threatens to damage any portion of the city sewer system, the service may be terminated without notice in an emergency situation. The department shall notify the customer, in writing, of the reasons for the discontinuance and the corrective action to be taken by the customer before service can be restored. (1973 Code § 13.40.080)
   C.   Fraudulent Use Of Service: When the department declares that a customer has obtained service by fraudulent means, the service to that customer may be discontinued without notice. The department shall not restore service to such customer until that customer has complied with the city sewer code and rules and reasonable requirements of the department, and the department has been reimbursed for the full amount of the service rendered and the actual cost to the department incurred by reason of the fraudulent use. Connection to the sewer system without having first obtained the necessary permits shall be considered such fraudulent use. (1973 Code § 13.40.090)
   D.   Procedure For Nonpayment:
      1.   Notice Of Termination: Each billing for sewer service shall indicate the date due for payment of that billing. If payment is not received within fifteen (15) days of the date due, the payment shall be deemed past due. If any bill for sewer or service charges, or part thereof, is not paid in full within forty five (45) days after the billing date, a twenty four (24) hour termination of water service notification shall be posted on the front door of the facility and an administrative fee at the rate found on the current city of Yerington fee schedule, administrative fee (posting 24 hour notice) will be added to the bill. If the invoice is not paid in full within the twenty four (24) hour period, the water service shall be immediately discontinued and shut off without further notice to the customer. An administrative fee at the rate found on the current city of Yerington fee schedule, administrative fee (shutting water off for nonpayment) will be added to the bill. Service will not be restored until the account is paid in full. (Ord. 03-03, 9-8-2003)
      2.   Request For Hearing: The owner or applicant applying for service, or the occupant of the premises, may request to present their position concerning termination of sewer services to the city council and the city council's action shall be final.
      3.   Failure To Appear: Failure of the owner, customer or occupant to appear before the city council after having requested such right, as provided above, will cause the sewer service to be terminated on the next working day.
      4.   Lien: On the date of termination of sewer services, or any date thereafter, the city may cause to be filed with the Lyon County recorder a statement of the amount due and unpaid for sewer services and a description of the property to which the services were rendered to perfect a lien against the property.
