The referendum shall not be applicable to: (1) measures submitting any measure to a vote of the electors; (2) measures not having the force or effect of law; (3) repealing measures passed by the Council pursuant to referendum petitions; (4) measures relating to any public improvement subsequent to the ordinance determining to proceed.
The referendum shall be applicable to emergency ordinances, but the filing of a referendum petition shall not prevent the emergency ordinance from taking effect. Any ordinance other than an emergency ordinance shall be suspended immediately by the determination that a referendum petition proposing to repeal the ordinance is valid. Within ten days after determining a referendum petition is valid, the Council shall have a summary of the proposed repealing measure published in a local newspaper or in a newspaper with general circulation in the Village or public media forum as allowed by Ohio law. At least three correct copies of the proposed repealing measure in the form in which it appears on the petition shall be made available for public inspection at the office of the Village. The summary shall describe the proposed repealing measure in brief and general terms and state that it is available for public inspection at the office of the Village, together with the time and place when it will be considered further by the Council in public hearing. The publication shall be at least ten days prior to the public hearing. No later than the second regular meeting following the public hearing the Council shall either pass the proposed repealing measure in its original form or take the action necessary to submit it to a vote of the electors at the next regular election or a special election to be called at the discretion of the Council. Action shall be taken not fewer than thirty days following Council action. If the repealing measure is approved by a majority of the electors voting, the repeal shall take effect immediately; otherwise the ordinance petitioned against shall become effective immediately. No repealing measure enacted by vote of the electors shall be amended or repealed by the Council in office at the time of the election enacting that repealing measure.
