648.09 MINOR'S CURFEW.
   (a)   Definitions. As used in this section:
      (1)   “Business” means any privately owned or operated retail establishment, including service stations, restaurants and places of a similar nature, and any place of amusement or entertainment to which the public or certain members thereof are invited.
      (2)   “Drive or ride aimlessly” means to drive or ride in a motor vehicle, motorcycle or bicycle in a circuitous route or to joy ride.
      (3)   “Loiter” means to idle, loaf, linger or wander or stroll aimlessly.
      (4)   “Minor” means any person under the age of eighteen years.
      (5)   “Operator” means any individual, firm, association, partnership or corporation operating, managing or conducting any business and, as applied to associations or partnerships, including the members or partners thereof and, as applied to corporations, including the officers thereof.
      (6)   “Parent” means any natural parent, guardian or any adult person over twenty-one years of age responsible for the care and custody of a minor.
      (7)   “Public place” means any public street, highway, road, alley, park, playground, public building, vacant lot or privately owned property permitted to be used by the public or certain members thereof.
   (b)   Unlawful Conduct of Minors.
      (1)   No minor shall loiter in or upon any public place or business between the hours of 11:00 p.m. and 6:00 a.m. of the following day, except that on Fridays and Saturdays the hours shall be from 12:00 midnight to 6:00 a.m. of the following day.
      (2)   No minor shall drive or ride aimlessly in a motor vehicle, motorcycle or bicycle between the hours of 11:00 p.m. and 6:00 a.m., except that on Fridays and Saturdays the hours shall be from 12:00 midnight to 6:00 a.m. of the following day.
      (3)   The provisions of this section shall not apply to:
         A.   A minor accompanied by a parent;
         B.   A minor proceeding home;
         C.   A minor at a place of business for legitimate purposes;
         D.   A minor on an errand directed or approved by the parent; or
         E.   A minor engaged in gainful lawful employment.
   (c)   Unlawful Conduct of Parents. No parent shall knowingly permit any minor in his or her charge to loiter in or upon any public place or business or to drive or ride aimlessly between the hours of 11:00 p.m. and 6:00 a.m. of the following day, except that on Fridays and Saturdays the hours shall be from 12:00 midnight to 6:00 a.m. of the following day.
   (d)   Unlawful Conduct of Owners or Operators of Businesses. No operator of a business, or agents or employees thereof, shall knowingly permit any minor to loiter upon the premises of the business between the hours of 11:00 p.m. and 6:00 a.m. of the following day, except that on Fridays and Saturdays the hours shall be from 12:00 midnight to 6:00 a.m of the following day.
   (e)   Enforcement. Any police officer who finds a minor in violation of any of the provisions of division (b) of this section shall obtain from the minor his or her name, address and age and the names of his or her parents. The minor shall thereupon be instructed to proceed to his or her home forthwith. A written notice shall then be mailed by the Chief of Police to the parents of the minor advising them of the violation of division (b) of this section.

   (f)   Penalties.
      (1)   Any parent who violates any of the provisions of division (c) of this section, after having received written notice of a violation of the curfew hours for loitering by the minor, is guilty of a minor misdemeanor.
      (2)   Any operator of a business, or an agent or employee thereof, who violates any of the provisions of division (d) of this section is guilty of a minor misdemeanor.
      (3)   Minors violating any of the provisions of division (b) of this section shall be dealt with in accordance with Juvenile Court law and procedure.
      (4)   A separate offense shall be deemed committed for each violation of any of the provisions of this section.
