1020.05 RETROACTIVE AND CORRECTIVE ACTIONS AND PROCEDURES.
   Where conditions exist at the time of passage of this section which have a deleterious effect on the public's use of a right-of-way, such conditions may be corrected by use of the following procedure:
   (a)   The owner of the adjoining property shall be notified by certified mail of the existence of the problem condition and given at least ten days to take corrective action.
   (b)   If the owner fails to act, the Village may take whatever corrective action is necessary.
   (c)   In cases where the problem condition is a consequence of the acts of commission or omission of the present or past owner of the adjoining property, the costs of correction may be billed to such owner and, if unpaid, may be certified to the County Auditor for collection at the same time and in the same manner as real property taxes are collected.
