(a) No transfer of a franchise shall occur without prior approval of the City Council.
(b) An application for a transfer of a franchise shall meet the requirements of § 808.08 and provide complete information on the proposed transfer, including details on the legal, financial, technical and other qualifications of the transferee, together with such additional supplemental information as is reasonably requested by the city relating to the aforesaid qualifications. If not otherwise provided on FCC Form 394 or its substitute, at a minimum the information required by § 808.10(b)(1) to (5) shall be provided with respect to the proposed transferee. The information required by § 808.10(b)(12) to (14) hereof shall also be provided whenever the proposed transferee expects material changes to occur in those areas, and the information required by § 808.10(b)(16) shall be provided if reasonably requested by the city.
(c) In making a determination as to whether to grant an application for a transfer of a franchise, the City Council shall consider the legal, financial, technical and other qualifications of the transferee to operate the system; whether operation by the transferee would adversely affect cable services to subscribers; whether the incumbent franchisee is in compliance with its franchise agreement and this chapter; and whether the transfer would otherwise be contrary to the public interest.
(d) No application for a transfer of a franchise shall be granted unless the proposed transferee certifies that information supplied to the city relating to the transfer request is accurate and agrees in writing that it will abide by and accept all terms of this chapter and the franchise agreement, and will assume the obligations and liabilities of the previous franchise under this chapter and the franchise agreement.
(e) Approval by the city of a franchise does not constitute a waiver or release of any of the rights of the city under this chapter or the franchise agreement whether arising before or after the date of the transfer.
