§ 1042.99 PENALTIES.
   (a)   Holding Event without Permit. Whoever violates Section 1042.01 of this Chapter by holding a parade, procession, assembly, block party, or other community event without the required permit is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of or pled guilty to the same violation, whoever violates Section 1042.01 is guilty of a misdemeanor of the first degree.
   (b)   Violation of Conditions. Whoever violates any of the conditions of a permit prescribed pursuant to Section 1042.04 of this Chapter shall be guilty of an unclassified misdemeanor and shall be fined no less than fifty dollars ($50) nor more than one hundred fifty dollars ($150).
   (c)   Restitution.
      (1)   Where a violation of any of the provisions of this Chapter or a violation of any of the conditions of a permit prescribed pursuant to Section 1042.04 of this Chapter results in or necessitates a response or manpower from the City's Police Division, Fire & EMS Division, or Public Service Department, the Court shall order the offender to pay the City restitution for the same.
      (2)   Where a violation of any of the provisions of this Chapter or a violation of any of the conditions of a permit prescribed pursuant to Section 1042.04 of this Chapter results in damage or injury to any City property, facility or employee, the Court shall order the offender to pay restitution for the same.
