§ 1042.03 DENIAL OR CANCELLATION OF PERMIT.
   (a)   Denial of Permit. A request for a community event permit may be refused or denied by the City Manager for any of the following reasons:
      (1)   The time, place, size, conduct, route, location, or assembly area of the parade, procession, assembly, block party, or other community event would unreasonably interfere with the public convenience and safe use of streets and rights-of-way.
      (2)   The adequate policing or traffic direction of the route, location, or assembly area of the parade, procession, assembly, block party, or other community event would require such a number of police officers so as to deny normal police protection to any other area of the City.
      (3)   The route, location, or assembly area of the parade, procession, assembly, block party, or other community event would unreasonably interfere with the movement of police vehicles, firefighting equipment, or emergency medical services to any other area of the City.
      (4)   The time, place, size, conduct, route, location, or assembly area of the parade, procession, assembly, block party, or other community event would unreasonably interfere with another parade, procession, assembly, block party, or other community event for which a permit has already been issued.
      (5)   The time, place, size, conduct, route, location, or assembly area of the parade, procession, assembly, block party, or other community event would, because of a permit which has already been issued, cause a violation of divisions (a)(2) or (a)(3) of this section.
      (6)   The City is unable to provide sufficient and proper staffing to provide any needed personnel at the time of the parade, procession, assembly, block party, or other community event.
      (7)   The information contained in the application is found to be false, misleading, or incomplete in any material detail.
      (8)   An emergency including, but not limited to, a fire, storm, flood, severe weather, or riot would prevent the proper or safe conduct of the parade, procession, assembly, block party, or other community event.
      (9)   The applicant(s) has been found guilty of a violation of this Chapter within the prior two (2) years.
   (b)   Cancellation of Permit. If, after having issued a community event permit, the City Manager finds that the conditions or facts upon which he or she relied in issuing the permit have materially changed, the City Manager is hereby authorized to cancel the issued permit.
   (c)   No Cause of Action. No person shall have any recourse against the City because their request for a community event permit was denied in accordance with division (a) hereof, or because a community event a permit was cancelled in accordance with division (b) hereof.
