§ 1040.05 FAILURE TO PAY UTILITIES BILL; SHUT-OFF NOTICES AND SURCHARGES.
   (a)   Unpaid Monthly Bills. If a monthly bill based on a regular monthly meter reading for continued utility services remains unpaid for a period of thirty (30) calendar days from the due date specified on the bill, a five- (5) day notice of shut-off shall be mailed to the billing address on file in the Accounts Receivable Division and, effective March 1, 2009, an additional charge of five percent (5%) of the unpaid charges shall be added thereto and become part of such unpaid charges.
   (b)   Unpaid Bills for Discontinued Utilities. In the case of bills for discontinued utility services not paid in full by the due date specified on the bill, when the person whose name is carried on the account does not continue services in that account name at another property serviced by City utilities, a delinquent notice shall be mailed to the forwarding address provided by the person whose name was carried on the account.
   (c)   Unpaid Bills when Utilities are Transferred to Another Property. In the case of bills for discontinued utility services not paid in full by the due date specified on the bill, when the person whose name is carried on the account does continue services in that account name at another property serviced by City utilities, a five- (5) day notice of shut-off shall be mailed to the person's current utility services address.
   (d)   Surcharges. The funds received from the collection of the additional monthly charges described in divisions (a), (b), and (c) hereof shall be deposited with the Finance Director. The funds so deposited shall be receipted by the Finance Director into the Water Fund, the Sewer Fund, the Stormwater Fund, the Sanitation Fund, based on the pro rata portion of unpaid water, sanitary sewer, stormwater, and sanitation charges upon which the additional charge was levied.
   (e)   Suspension of Services. If any bill for utility services remains unpaid for a period of thirty (30) calendar days from the due date of the bill, the services will be subject to suspension. Utility services, including water, to such property, as described in divisions (a), (b), and (9) hereof may therefore be suspended and shall be resumed only after payment of all utility charges past due, including a disconnection service fee, as set forth in Part Two, Title Twelve, Chapter 298 of these Codified Ordinances. The Director of Finance shall yearly recommend to the City Council, at its first regular meeting in November, the amount of the disconnection service fee based on an annual cost analysis.
